HODGKINS FARM PRIVATE COVENANTS
THESE CONVENANTS MAY BE REVISED
FROM TIME TO TIME BY THE MAJORITY VOTE OF THE LOT OWNERS (SEE
HOMEOWNERS ASSOCIATION RULES FOR
DEFINITION OF MAJORITY):
1. Each lot shall be used for single family residential purposes
exclusively.
2. No duplex residence or apartment house shall be erected
or placed on any lot and no buildings shall be altered or converted
into a duplex residence or apartment house.
3. The area of any dwelling exclusive of porches, breezeways,
and garage shall not be less than 930 square feet. Minimum
width of such houses shall be 24 feet. Minimum roof pitch on
all houses shall be 5/12’ pitch. All homes shall have
a full basement or foundation crawl space.
4. No livestock, animals or poultry other than household pets
shall be kept, maintained or allowed on any of the lots. No
boarding or breeding kennels may be kept or maintained on any
of the lots.
5. No temporary dwellings of any size shall be placed, erected
or maintained on any of the lots. Vehicles which do not have
a current state inspection sticker may not be stored out of
doors on any lots. No trade, business, profession, or commercial
trade of any nature shall be conducted on any of the lots.
6. All exterior construction work on any buildings or other
structures including the restoration of the premises and landscaping,
shall be completed within eight months from the date of construction,
including excavation, begins.
7. The wholesale cutting of trees on a lot, whether for commercial
lumbering or otherwise is prohibited.
8. Prior to the date of execution and recording of this declaration,
there has been formed the Hodgkins Farm Homeowners Association,
a nonprofit non-stock corporation organized and existing
under the laws of the State of Maine (hereinafter called
the “association”). Each owner of a lot shall
automatically become a member of the association, and as
long as he continues as the owner of a lot and each owner
of a lot in said plan shall automatically become and be a
member of the association as long as he continues as the
owner of a lot. Upon termination of interest an owner in
a lot, his membership and any interest in the association
shall thereupon automatically terminate and transfer and
inure to the next owner of his lot succeeding him in interest.
Each owner of a lot shall be bound by the bylaws of the association,
as the same may be amended from time to time, and each owner
of a lot shall comply strictly with said bylaws of the association.
No holder of a mortgage of a lot shall be considered as lot
owners until such holder shall acquire title by foreclosure,
by deed in lieu of foreclosure, or by maintaining possession
of the lot.
9. Owners of a lot must pay their proportionate amount of
road maintenance, managed by the above fore mentioned association.
10. The area on each lot located between any boundary line
and its associated setback line shall be maintained as a vegetative
buffer except for cutting required for a driveway, well and
septic placement, and for the removal of dead vegetative matter.
