SPRUCE
POND COVENANTS AND RESTRICTIONS
The ownership, occupancy, use and conveyance of each Lot are
subject to the following restrictions:
1. Each lot shall be used for single family residential purposes
exclusively.
2. No structure shall be erected or moved to any Lot except
one detached, single family residential dwelling, hereinafter
referred to as a dwelling, of not more then two stories in
height and such other buildings necessary and subsidiary to
the same such as a garage, solarium or storage building. In
order to preserve the architectural aesthetics, no mobile or
modular home shall be erected or moved onto the premises unless
it has a factory-installed asphalt, shingled, pitched roof,
shingled or clapboard siding and is installed on a permanent
foundation. Each dwelling prior to occupancy, shall have a
running water system and a sewage disposal system both of which
shall conform to the State of Maine Plumbing Code.
3. No duplex residence, garage apartment or apartment house
shall be erected or placed on any Lot and no buildings shall
be altered or converted into a duplex residence, garage apartment
or apartment house.
4. No structure shall be placed on any Lot outside of the
setbacks shown on the subdivision Plan for each Lot. The above
side lot line restrictions shall not apply to the dividing
lines between Lots owned by the same person or persons as long
as such Lots remain under such ownership.
5. The area of any dwelling exclusive of porches, breezeways,
and garage shall be not less than 807 square feet.
6. No livestock, animals or poultry other than household pets
shall be kept, maintained or allowed on any of the Lots. No
boarding or breeding kennels may be kept or maintained on any
of the Lots.
7. No camper trailers, no tents or temporary dwellings of
any size shall be placed, erected or maintained on any of the
Lots. Vehicles which do not have a current State inspection
sticker may not be stored out of doors on any Lots. No trade,
business, profession or commercial trade of any nature shall
be conducted on the Lots.
8. All exterior construction work on any buildings or other
structures, including restoring the premises and landscaping,
shall be completed within eight months from the date construction,
including excavation, begins.
9. The wholesale cutting of trees on a Lot, whether for commercial
lumbering purposes or otherwise, is prohibited. The does not
prevent a Lot owner from cutting trees to construct or enhance
the homesite on the Lot to provide a view from his Lot or to
preserve the wooded environment of his Lot. No cutting shall
take place in the areas shown as Buffer Zones, on individual
lots and the common areas.
10. Prior to the date of the execution and recording of this
Declaration, there has been formed the SPRUCE POND HOMEOWNERS
ASSOCIATION. A non-profit non-stock corporation organized and
existing under the laws of the State of Maine (hereinafter
called the “Association”). Each owner of a Lot
shall automatically become a member of the Association, as
long as he continues as the owner of a Lot and each owner of
a Lot in said Plan shall automatically become and be a member
of the Association as long as he continues as the owner of
a Lot. Upon termination of interest an owner in a Lot, his
membership and any interest in the Association shall thereupon
automatically terminate and transfer and inure to the next
owner of his Lot succeeding him in interest. Each owner of
a Lot shall be bound by the By-Laws of the Association, as
the same may be amended from time to time, and each owner of
a Lot shall comply strictly with the said By-Laws of the Association.
No holder of a mortgage of a Lot shall be considered as Lot
owners until such holder shall acquire title to the Lot by
foreclosure, by deed in lieu of foreclosure, or by maintaining
possession of the Lot.
11. No satellite dishes larger than 24 inches in diameter
may be placed on any Lot.
12. The type and location of the home, fencing, and accessory
structures to be constructed or placed on a Lot by a Lot owner
must be approved in writing by the Developer, its successors
and assigns, or by the Homeowners Association upon the sale
of all property within the Spruce Pond Subdivision.
13. Recreational vehicles shall not be used on any property
within the Spruce Pond Subdivision. They may be stored on a
private lot only if well screened from view from the road,
and abutters.
14. Each Lot owner shall keep the Lot and home in a neat and
well-maintained appearance.
15. Each Lot owner shall cooperate with the Spruce Pond Homeowners
Association in the inspection and pumping of their septic tank
according to the guidelines for the homeowners association
and appendix A and make prompt payment for the cost of these
services.
16. The septic system for the Spruce Pond Subdivision is designed
to accommodate 75 homes with a total of 188 bedrooms, an average
of 2.5 bedrooms per home. At any tine a homeowner wishes to
expand their number of bedrooms, they must first obtain approval
from the Spruce Pond Homeowners Association through the board
of directors. The directors shall grant approval as long as
the total number of bedrooms for any individual home does not
exceed 3, and the total number for the subdivision will not
exceed 188. If the maximum of 188 would be exceeded, then the
directors shall first endeavor to obtain a design for expansion
of the septic system and a valid plumbing permit. If the design
and permit can be obtained, then the request for an expansion
of bedrooms shall be granted. If the design and permit cannot
be obtained, then that request and any further requests shall
be denied. In any case, no home shall have more than 3 bedrooms.
